1. Agreement to Terms
By accessing or using the Prodgator platform (“Service”), operated by Secret Headquarters, LLC (“Company”, “we”, “us”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree to these terms, you may not access or use the Service.
2. Description of Service
Prodgator is a real-time CI/CD pipeline monitoring and analytics platform. The Service provides:
- Real-time monitoring of CI/CD pipeline runs, stages, and deployments
- AI-powered failure classification and anomaly detection
- DORA metrics and engineering analytics
- Security alert aggregation and compliance policy tracking
- Notification and alerting capabilities
- Integration with third-party source control providers (e.g., GitHub)
3. Accounts and Access
Access to the Service requires authentication through our identity provider, WorkOS AuthKit. You are responsible for maintaining the security of your authentication credentials and for all activity that occurs under your account.
The Service uses organization-based multi-tenancy. Organization administrators manage user access, roles, and permissions within their organization. The available roles (reader, operator, editor, and admin) each grant different levels of access as described in the product documentation.
You agree to provide accurate information during registration, promptly revoke access for users who should no longer have it, and notify us immediately of any unauthorized access to your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Use automated means (bots, scrapers, etc.) to access the Service beyond what the provided APIs support
- Transmit malicious code or content through the Service
- Resell or redistribute the Service without prior written consent
5. Third-Party Integrations
The Service integrates with third-party platforms, including GitHub, to retrieve CI/CD pipeline data, repository metadata, and related information. When you connect a third-party account:
- You authorize Prodgator to access data from those platforms on your behalf within the scope of permissions you grant
- You are responsible for ensuring you have the right to share that data with the Service
- Third-party integrations are subject to the respective platform’s own terms of service
- We are not responsible for the availability, accuracy, or conduct of any third-party service
6. Intellectual Property
The Service, including its design, code, features, and documentation, is the property of Secret Headquarters, LLC and is protected by intellectual property laws. Your use of the Service does not grant you ownership of any intellectual property in the Service.
You retain all rights to the data you provide to the Service (“Customer Data”). You grant us a limited license to process your Customer Data solely for the purpose of providing and improving the Service as described in these terms and our Privacy Policy.
7. AI-Powered Features
The Service includes AI-powered features such as failure classification, anomaly detection, and intelligent alerting. Regarding these features:
- No training on customer data. We do not use your data to train AI or machine learning models. Your pipeline data, logs, and organizational information are never used as training data.
- AI-generated insights are provided as analytical aids and should not be treated as definitive conclusions
- You are responsible for decisions made based on AI-generated analysis
8. Data Handling and Security
We take the security of your data seriously. Details about what data we collect and how it is processed are described in our Privacy Policy. In summary:
- Customer Data is logically isolated by organization
- All data is encrypted in transit (TLS) and at rest
- Webhook payloads are stored with automatic expiration (TTL)
- We implement role-based access controls to limit data exposure within your organization
9. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime. We are not liable for any loss or damage resulting from Service unavailability.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Secret Headquarters, LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your access to or use of (or inability to access or use) the Service. Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times, or that defects will be corrected.
12. Termination
Either party may terminate this agreement at any time. You may stop using the Service and request deletion of your account. We may suspend or terminate your access if you violate these terms or if we discontinue the Service.
Upon termination, your right to access the Service ceases immediately. We will delete your Customer Data in accordance with our data retention practices described in the Privacy Policy, unless retention is required by law.
13. Changes to Terms
We may update these terms from time to time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised terms. If you do not agree with the changes, you must stop using the Service.
14. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from or related to these terms or the Service shall be resolved in the courts located in Delaware.
